  • LPRC Enterprises, LLC DBA: Kitchen Design Magic reserves the right to manage, modify, or delete User Accounts at its discretion, without liability to you.

You are solely responsible for maintaining the security of your User Account. This includes:

  • Ensuring your credentials (passwords or other authentication methods) are strong and secure.
  • Keeping your account information accurate and up to date.
  • Protecting your account from unauthorized access.

You agree to notify us immediately of any breach of security or unauthorized use of your User Account. We disclaim liability for any losses or damages arising from unauthorized account access.

You may configure your User Account and preferences through the account settings page. By providing your email address, you consent to receive Service-related communications, including:

  • Marketing emails with updates, offers, and promotions.

You may opt out of marketing communications by contacting support or using the "unsubscribe" option provided in the emails. Opting out of marketing emails will not affect your ability to receive essential Service-related notifications.

LPRC Enterprises, LLC DBA: Kitchen Design Magic provides an AI-powered kitchen design service that allows users to upload photos of their kitchens and generate kitchen design concepts and visualizations using artificial intelligence technology. The Service includes:

  • AI-generated kitchen design concepts based on uploaded photos
  • Design visualization tools and recommendations
  • User interface for uploading room images and design preferences
  • Credit-based usage system
  • Product recommendation lists with affiliate links

Important disclaimers:

Entertainment Purpose Only: This design service is provided for entertainment purposes only and should not be taken as professional building design, construction, or interior design advice. Users should undertake any home renovation project at their own risk and should seek professional help, especially to ensure compliance with all applicable local, state, and federal building codes and safety requirements.

AI-Generated Content: Due to the nature of artificial intelligence technology, we cannot guarantee the accuracy, appropriateness, or suitability of AI-generated designs. If any AI-generated photo resembles anyone's actual kitchen or a copyrighted photo, it is by pure coincidence and not intentional.

4.2. License Grant

Subject to your compliance with these Terms and any applicable guidelines, documentation, or instructions provided by LPRC Enterprises, LLC DBA: Kitchen Design Magic, we grant you a non-exclusive, non-transferable, limited, and revocable license to access and use the Service. This license is provided solely for your personal use or internal business purposes, as permitted by the features of the Service and your applicable credit package.

This license is conditional upon:

  • Your adherence to these Terms and all Applicable Laws, including local, state, national, and international laws, rules, and regulations.
  • Your use of the Service in accordance with its intended purpose and functionality.
  • Timely payment of any associated fees and maintenance of sufficient credits.

LPRC Enterprises, LLC DBA: Kitchen Design Magic reserves the right to modify, suspend, or terminate your access to the Service at any time, for any reason or no reason, without prior notice or liability. All rights not expressly granted to you herein are reserved by LPRC Enterprises, LLC DBA: Kitchen Design Magic.

5. Photo Uploads and AI Content Policies

5.1. Photo Upload Requirements

When using our Service, you may upload photos of kitchens to generate AI-powered design concepts. By uploading photos, you represent and warrant that:

  • You own the photos or have the legal right to upload and use them
  • The photos do not contain images of real people or individuals
  • The photos do not violate any third-party rights, including privacy, publicity, or intellectual property rights
  • The photos do not contain illegal, inappropriate, or offensive content

5.2. Prohibited Photo Content

You agree that you will NOT upload photos that:

  • Contain images of real people or individuals in any form
  • Are illegal, inappropriate, offensive, or violate any applicable laws
  • Infringe upon any third-party intellectual property rights
  • Contain copyrighted material that you do not own or have permission to use
  • Violate any person's privacy or publicity rights

Our Service is not designed to handle photos or images of people, and users should not upload any photos with real people in them.

5.3. AI Content Disclaimers

No Liability for AI-Generated Content: Due to the nature of artificial intelligence technology, we are not responsible or liable if the AI tool creates an inappropriate, inaccurate, or unintended design output. This includes but is not limited to:

  • Designs that may be structurally unsound or unsafe
  • Content that may inadvertently resemble copyrighted material
  • Designs that may not comply with building codes or safety regulations
  • Any inappropriate content generated accidentally by the AI system

User Responsibility: If you encounter any inappropriate or problematic AI-generated content, you agree to notify us immediately so we can take appropriate action and improve our AI algorithms.

No Professional Advice: AI-generated designs are for entertainment and inspiration purposes only and do not constitute professional architectural, engineering, construction, or interior design advice.

Coincidental Resemblance: If any AI-generated photo resembles anyone's actual kitchen or a copyrighted photo, it is by pure coincidence and was never our intent.

5.4. Affiliate Links and Product Recommendations

Our Service may provide product recommendation lists that include affiliate links to third-party retailers. By using these links, you acknowledge and agree that:

  • We may receive a small commission at no extra cost to you if you purchase products through these links
  • We do not sell the actual products and are not responsible for product quality, shipping, returns, or customer service
  • Any refunds, quality concerns, or order issues must be resolved directly with the retailer
  • Product recommendations are for informational purposes only and do not constitute endorsements
  • We use cookies and tracking technologies to monitor affiliate link clicks and commissions

6. Payment Terms and Credit System

6.1. Credit-Based System

The Service operates on a credit-based system. Users purchase credits that are consumed when generating kitchen designs. Each design generation consumes a specified number of credits as indicated in the Service interface.

6.2. Payment Processing

All payments are processed through Stripe, Inc. ("Stripe"), a third-party payment processor. By making a purchase, you agree to be bound by Stripe's Services Agreement and any other applicable Stripe terms. You acknowledge that LPRC Enterprises, LLC DBA: Kitchen Design Magic does not store or have access to your payment information, which is handled securely by Stripe.

6.3. Pricing and Fees

Current pricing for credit packages is displayed on our website and may be updated from time to time at our sole discretion. All fees are stated in U.S. dollars and are non-refundable except as expressly provided in these Terms, including the Money-Back Guarantee described in Section 6.4 below.

6.4. 100% Risk-Free Money-Back Guarantee

We stand behind our Service with a 100% Risk-Free Money-Back Guarantee. If you are not satisfied with your Silver or Gold plan purchase, you may request a full refund within 30 days of your purchase date by emailing carrie@pennymodern.com. Please include the email address associated with your account so we can locate your purchase.

Refund requests submitted after the 30-day window, or for purchases outside the Silver or Gold credit packages (such as individually redeemed promo codes), are not covered by this guarantee and remain non-refundable.

6.5. Credit Expiration

Credits do not expire. Once purchased, credits remain in your account indefinitely and may be used at any time while the Service remains operational.

6.6. Business Closure

In the event that LPRC Enterprises, LLC DBA: Kitchen Design Magic ceases operations or discontinues the Service for any reason, no refunds will be provided for unused credits. You acknowledge and agree that the purchase of credits does not guarantee continued access to the Service, and LPRC Enterprises, LLC DBA: Kitchen Design Magic shall have no obligation to provide refunds, compensation, or alternative services in the event of business closure or service discontinuation.

7. Data Storage and Security Disclaimers

7.1. Data Storage

Our Service may store various types of user information online, including but not limited to:

  • User photos uploaded to the Service
  • AI-generated design images and outputs
  • Personal information such as name, email address, phone number
  • Account credentials (usernames and encrypted passwords)
  • Usage data and preferences
  • Any other information you choose to provide

7.2. Security Efforts and Limitations

Best Efforts: We will do our best to protect and secure all stored information using industry-standard security measures and practices.

No Liability for Data Breaches: However, we shall not be held liable if a data breach occurs. You acknowledge and agree that:

  • No security system is completely impenetrable
  • Data breaches can occur despite best security practices
  • We disclaim all liability for unauthorized access to or disclosure of your information
  • You use the Service at your own risk regarding data security
  • We will make reasonable efforts to notify users in the event of a data breach as required by applicable law

7.3. Account Security

We will do our best to keep user accounts secure through:

  • Encrypted password storage
  • Secure login processes
  • Regular security monitoring and updates

However, users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.

8. Restrictions and Prohibited Activities

To maintain the integrity and security of the Service, and to ensure compliance with applicable laws, you agree that you will not engage in technical interference, misuse of content, or illegal activities in connection with the Service.

9. Intellectual Property Rights

The Service and all materials therein are the exclusive property of LPRC Enterprises, LLC DBA: Kitchen Design Magic and its licensors, with specific provisions for user-generated content and generated designs.

10. Disclaimers and Warranties

The Service is provided on an "as is" and "as available" basis. LPRC Enterprises, LLC DBA: Kitchen Design Magic disclaims all warranties of any kind, express or implied.

11. Limitation of Liability

To the maximum extent permitted by applicable law, LPRC Enterprises, LLC DBA: Kitchen Design Magic's liability shall be limited as set forth in these Terms.

12. Indemnification

You agree to indemnify and hold harmless LPRC Enterprises, LLC DBA: Kitchen Design Magic from claims arising from your use of the Service or violation of these Terms.

13. Termination

Either party may terminate access to the Service, with specific provisions regarding unused credits and continuing obligations.

14. Dispute Resolution

These Terms shall be governed by applicable state law, with specific jurisdiction and class action waiver provisions.

15. General Provisions

These Terms constitute the entire agreement and include standard legal provisions regarding severability, assignment, and contact information.
